1. Scope
These general terms and conditions apply to all contracts and services offered by Mr. Joachim Trell, acting as Ingenieurbüro Trell (hereinafter “IBT”). Deviating agreements or the exclusion of the general terms and conditions require express confirmation in text form. The validity of the customer’s general terms and conditions is hereby contradicted.
2. Scope of services, copyrights
IBT provides consulting services. A contract is concluded with the order confirmation in text form from IBT. The IBT offer is aimed exclusively at entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB).
If IBT provides a service on the customer’s premises, the customer will provide the infrastructure necessary to carry out the service, and in particular the workstation, computer and PPE, in a functional manner at his own expense and risk and prepare any online connections that may be necessary.
Unless otherwise agreed in text form, documentation and training materials provided as part of the provision of services may not be published, reproduced, reprinted, translated or passed on to third parties, even in extracts.
3. Cancellation
The customer can withdraw from the contract until the services begin. Withdrawal must be declared in writing. A withdrawal by the customer is free of charge if it is made no later than 14 days before the start of the service and IBT has not yet incurred any costs; Otherwise, these must be reimbursed in full against proof. If the written declaration of withdrawal is received later, the customer must pay the full remuneration for at least 3 full days of service. The receipt of the letter of withdrawal is decisive for compliance with the deadline.
4. Compensation, payment terms
The prices stated in the offer documents apply plus VAT at the statutory rate. They are due for payment without deduction upon invoicing.
5. Security
IBT will give the customer a safety briefing on site on the first day of work. Liability due to intent or gross negligence is excluded.
6. Liability
Any further claims by the customer than those expressly stated in this agreement, regardless of the legal basis, are excluded unless they are based on intentional or grossly negligent behavior on the part of IBT or its vicarious agents or on culpable injury to life, body or health.
If an event is canceled due to the above. There is no right to the event taking place due to reasons, force majeure or other unforeseeable events. In such cases, IBT cannot be obliged to reimburse travel/accommodation costs or loss of work. No liability is accepted for indirect damages, in particular lost profits or third-party claims.
7. Applicable law, place of jurisdiction
The contract is subject to German law to the exclusion of international sales law (CISG).
If the customer is a merchant within the meaning of the Commercial Code, the place of jurisdiction is Landsberg am Lech.
IBT expressly points out that customer data is stored and processed to fulfill orders and maintain ongoing customer relationships. Third parties involved receive this data only to the extent necessary for the fulfillment of the order. The provisions of the Federal Data Protection Act are observed.

Requests for information in accordance with Section 34 BDSG can be addressed to him and must be accompanied by proof of identity or authorization. Such information is always free of charge for customers and their employees; for third parties, one-off information within 12 months is free of charge.
